1. Acceptance of Terms

Welcome to Roadside Assistance and Dispatch. By downloading, accessing, or using our mobile application and website (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service.

2. Description of Service

Roadside Assistance and Dispatch is a roadside assistance and towing dispatch platform that connects customers requesting roadside services (such as towing, lockouts, jump starts, fuel delivery, tire changes, and winching) with independent service providers. We act as a dispatch and connection platform and are not a towing or roadside service provider ourselves.

3. User Accounts

To use certain features of the Service, you must register for an account. You agree to:

• Provide accurate and complete registration information.
• Maintain the security of your account credentials.
• Be responsible for all activities under your account.
• Promptly notify us of any unauthorized use or security breach.
• Be at least 18 years old to create an account.

You may delete your account at any time through the app's Account settings. Upon deletion, your personal data will be removed in accordance with our Privacy Policy.

4. Customer Responsibilities

• Provide accurate location, vehicle, and contact information when requesting service.
• Be present at the pickup location or ensure access for the service provider.
• Pay all applicable fees for services rendered, including dispatch and service charges.
• Treat service providers with respect and comply with all applicable laws.

5. Service Provider Responsibilities

• Maintain all required licenses, permits, and insurance to perform roadside and towing services.
• Provide accurate information about services, coverage area, and pricing.
• Respond to dispatched jobs promptly and professionally.
• Maintain active subscription status to receive dispatch calls, and keep the app installed with notifications enabled.
• Comply with all applicable federal, state, and local laws and regulations.

6. Payments and Subscriptions

Service providers may subscribe to subscription tiers (Free, Pro, or Elite) to receive dispatch jobs. Subscriptions are billed through our third-party payment processor. Subscription fees are non-refundable except as required by law. You may cancel your subscription at any time; cancellation takes effect at the end of the current billing period.

Customer payments for individual services may be processed through the platform via central billing, provider billing, or direct customer payment, depending on the job configuration.

7. Acceptable Use

You agree not to:

• Use the Service for any illegal or unauthorized purpose.
• Submit false, misleading, or fraudulent service requests.
• Interfere with or disrupt the Service or servers.
• Attempt to gain unauthorized access to any portion of the Service.
• Harass, abuse, or harm other users or service providers.
• Use the Service to solicit business outside of the platform's intended purpose.

8. Disclaimers and Limitation of Liability

The Service is provided on an "as is" and "as available" basis. Roadside Assistance and Dispatch is a dispatch platform and does not perform roadside services itself. We are not responsible for the acts or omissions of service providers, including the quality, timeliness, or outcome of any service performed.

To the maximum extent permitted by law, Roadside Assistance and Dispatch shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, vehicle damage, personal injury, or delays in service.

9. Indemnification

You agree to indemnify and hold harmless Roadside Assistance and Dispatch and its affiliates from any claims, damages, liabilities, costs, or expenses (including legal fees) arising from your use of the Service, your violation of these Terms, or your infringement of any third-party rights.

10. Account Termination

You may delete your account at any time through the app. We reserve the right to suspend or terminate your access to the Service at our sole discretion, without notice, if you violate these Terms, engage in fraudulent activity, or pose a risk to the safety or integrity of the platform.

11. Changes to Terms

We may modify these Terms at any time. We will notify users of significant changes through the app or by other means. Continued use of the Service after changes are posted constitutes acceptance of the revised Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with applicable federal and state laws, without regard to conflict of law principles. Any disputes shall be resolved in the courts having jurisdiction over the location where Roadside Assistance and Dispatch operates.
